Jabfab, Inc. is an online service where consumers are able to share their sentiments on any topic or entity. In the same service, consumers or organizations/businesses can also monitor these sentiments and “listen” to the aggregate of sentiments for particular topics or review the individual comments made with postings of sentiment to Jabfab.

Users of the site will post structured sentiments that indicate how they feel about a particular topic (whether positive or negative – Jab or Fab) and their comments and level of intensity of feelings. These postings of sentiment may contain attached photographs, images, or other multimedia content.

This Privacy Policy Statement("Statement") describes the personal information we collect through our websites and mobile applications (the"Site"),and how we collect and use it. The terms"we,” “us," and"Jabfab"refer to Jabfab, Inc., a Delaware corporation.

Account Information: We ask for and store personal information about you when you create an account on the Site. When we refer to"Personal Information" we mean information such as your name or other information that enables us to reasonably identify you and other information we may associate with this information like your date of birth, email address, and optional other information you may provide, such as name, gender, and home location. You can also sign up from a third party (e.g., Facebook) to make the Jabfab registration process simpler. We ask you to create a username that is unique and may be chosen by you. We use your email address to send you updates, provide services to you in connection with the Site, and to contact you on behalf of others sending you messages, complements and, rewards, etc. We may also use your signup location, birth date, and gender (if you supply them) to display relevant advertising to you, along with the nature of your Jab or Fab posting. You can change your account information at any time by visiting the Settings page under your user profile.

Public Content: You can contribute to the Site in a number of different ways, including posting Jab or Fab sentiments, uploading photos, participating in Jabs or Fabs already created and posted by others, filling out your profile, and sharing your sentiments with your “social graph” via connected social networks (e.g., Facebook or Twitter). We may store these contributions (your "Public Content"), display them to other users, and use them for promotional purposes. Note that if you include personally identifiable information in your Public Content, it can be used and viewed by others. We are not responsible for the information you choose to include in your Public Content.

Messaging: The Site may allow you to post your sentiments via texting or SMS on your mobile phone or device. We may store these messages in order to deliver them. The Site may also allow you to send information from the Site to your phone via text message. In order to carry out these requests, we may log your phone number, your carrier, and the date and time that the message was processed. Your carrier may charge you for texts that you receive or send. You agree and authorize any text messages that you may receive through the Site when you provide us with your mobile number.

Location Data: The Site can provide helpful information based on where you are. If you tell us where you are (e.g., by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based information and advertising. If you want to deactivate this feature, you can either reinstall the application or deactivate GPS on your mobile device. The Site may also allow you to tell other users where you are, if you choose.

Inviting Friends: You can invite people to join the Site by providing their email address(es). We may store and use your friends' email address to send them this invitation, on behalf of you, to join Jabfab. Your friends will have the opportunity to accept or decline the invitation, and opt out of receiving further emails from us as required by law. Recipients of our commercial email may opt out by emailing their request to: do-not-email-me@jabfab.com which we will attempt to honor promptly.

Third-Party Services: We allow you to access third-party services, such as Facebook and Twitter, to share your selected Public Content with those services, and may enable you to import information about who you are connected with on those other services so you can connect with them on the Site. You can always opt out by changing your Connections settings in your Jabfab profile page. Some of those third-party services may also provide us with information from your accounts with those services to help us enhance and personalize your use of this Site. For example, you can allow Facebook to tell us who your Facebook friends are so you may, in future, be able to follow their activity on Jabfab. You can also further modify your privacy settings with those other services directly. For example, you can adjust your privacy setting on Facebook itself.

Activity and Log Data: We may store information related to your use of the Site, such as the pages you view on the Site, your browser type, IP address, the phone numbers and names of businesses that you call through the Site, requested URL, browser language, referring URL, and the date and time of your visit. We use this type of information to administer the Site and improve our services to you and others. We also use this information in the aggregate to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Site. For Jabs or Fabs that are posted by an Anonymous user (i.e., someone who is contributing to Jabfab that does not have a user account), we will still log the IP address associated with that sentiment. Jabfab does not consider IP address to be Personal Information. We use activity and log data to help Jabfab users analyze aggregate postings data, for sentiment analysis programs or initiatives. As with most of the Internet, you should NOT assume that simply because you created an account anything you say or do on Jabfab will be untraceable and you should behave responsibly and ethically. We reserve the right to investigate abuses on the Site, and enforce and apply our Terms of Service and Privacy Policy Statement.

Cookies: We may send cookies to your computer in order to uniquely identify your browser and improve the quality of our service."Cookies" refer to small pieces of information that a website sends to your computer's hard drive while you are viewing the Site. We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). Persistent cookies can be removed by following your browser help file directions. If you choose to disable cookies, some areas of the Site may not work properly or at all. We may enable some of our business partners to use cookies in conjunction with your use of the Site. We have no access to or control over the use of these cookies. These cookies may collect information about your use of the Site, such as where you came from, which pages you visited within the Site, and possibly other sites you visit if those sites cooperate with the same third party, but do not collect your name, email address, contact information or other personally identifiable information that by itself would allow the third party to identify or contact you.

Feedback: You should feel free to give us feedback, register complaint(s), or ask questions about the Site. We may store your communications, including any personal information you include in them, so that we can effectively respond to you. You may provide your feedback by sending an email to  feedback@jabfab.com.

Administration: We may use the information described above for routine administrative purposes, such as investigating abuses on the Site, responding to user inquiries and enforcing and applying our Terms of Service and Statement.

Credit Card Purchases: If you purchase a data services subscription or other Jabfab products and services online, we collect and store billing and credit card information. This information will only be shared with third parties who perform tasks (such as fulfilling orders and processing credit card payments) required to complete the purchase transaction. When you enter sensitive information (such as a credit card number) on our registration or order forms, we use appropriate security measures to protect data we receive.

Public Content: If you post content for public view on the Site, we may distribute such Public Content to a wider audience by sharing it (all or portions of it) with third parties so that they can publish it on their own websites and media platforms. We may ask them to credit you as the source of these contributions by including your account user-name and/or profile photo.

Third-Party Service Providers: We may use third parties to provide technical and customer support, perform tracking and reporting functions, conduct quality assurance testing, perform payment processing and provide other services in connection with the Site. We may share information about you with them so that they can perform the services they are required to perform, but they are not permitted to use your personal information other than to provide the services requested by you.

Third-Party Advertising: Third parties may serve some of the ads on the Site. We do not send any individualized personal information to them. The sentiment data feeds available via subscriptions to Jabfab will only include a unique ID number allocated using an auto-numbering system, to assist with uniquely identifying a user entity. They will not include personally identifiable information such as user-name, first name, last name, or email address. Third-party advertisers may have access to information that they obtain through cookies or that you share with them yourself. Note that we do not rent, share, sell, or trade personally identifiable information with third parties for their direct marketing purposes. Advertisers and businesses may have subscribed to the anonymous data subscriptions available by Jabfab, but these do not include personally identifiable information such as user name, first name, last name or email address, and a user (or their sentiment posts). Rather, our data feeds only contain a non-personalized unique ID number, the user gender (if present in the profile), location (if present in the post or profile) and the sentiment summary, along with other anonymous information regarding the sentiment posting.

Investigations: We reserve the right to investigate abuses on the Site, and enforce and apply our Terms of Service and Privacy Policy Statement. We may disclose information about you to third parties if we believe such disclosure is reasonably necessary to:

1. Take action regarding suspected illegal activities;
2. Enforce or apply our Terms of Service and Privacy Policy Statement;
3. Comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; or
4. Protect our rights, reputation, and property, or that of our users, affiliates, or the public;

Merger, Sale, or Other Asset Transfers: If Jabfab is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be sold or transferred as part of that transaction. Jabfab does not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this Privacy Policy.

We provide tools to manage the use of information we receive through the Site. You may receive regular electronic communications from us. However, despite any requests to close your account or your indicated email preferences, we may still need to contact you as required by law or on legal and administrative matters, for example to inform you of any updates to our Terms of Service or this Privacy Policy Statement and you agree that we may do that.

The Site may contain links to third-party websites with which we have no affiliation. Except as set forth here, we do not share your personal information with those third parties, and are not responsible for their privacy practices. We suggest you read the privacy policies on all such third-party websites.

The Site is intended for general audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13, and we do not encourage any person(s) under 13 to join Jabfab. If we become aware that a child under 13 has provided us with personal information without parental consent, we will take steps to remove such information. Our anonymous posting of Jabs and Fabs will ask users how old they are before allowing the submission of any content, and will not enable content to be posted by those under 13 years of age. Our user registration/sign-up process will not enable those who indicate that they are under 13 years of age to process their registration – date of birth is a mandatory field collected during this process.

We take steps to protect the personal information submitted to us. No method of transmission over the Internet, or method of electronic storage is 100% secure, however. So, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

If Jabfab learns of a security system’s breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using this Site or providing account information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of this Site. Jabfab may post a notice on this Site if a security breach occurs. If this happens, you will need a web browser or mobile device enabling you to view the Jabfab Site. Jabfab may also send an email (or other communication such as a text message) to you at the contact details you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us at security@jabfab.com.

Because Jabfab may operate globally, we may transfer your account and other information within our global operations to fulfill our obligations to you, but always subject to the limitations of applicable data protection law and this Statement. Privacy laws differ across the globe. To help visitors whose native language may not be English understand our privacy practices, we may provide special information on our privacy practices that may be applicable to these visitors in different languages. Jabfab entities outside the United States may have supplemental privacy policies that may apply in those countries.

If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, including those whose privacy laws may be stricter than U.S. law, please note that you are transferring your personal data to the United States to Jabfab. By providing your personal data you consent to that transfer.

We may revise this Statement from time to time. The most current version will govern our use of your information. If we make a change to this Policy that, in our sole discretion, is materially less restrictive on our use of information you have provided to us, we will make reasonable steps to notify you of the changes prior to implementation. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Statement.
